Terms & Conditions

Welcome to Street Way Holidays Pvt. Ltd. By booking a tour, retreat, or any travel service with us, you (“the Client” or “the Traveler”) acknowledge that you have read, understood, and agree to be legally bound by the following Terms and Conditions, which form the entire agreement between you and Street Way Holidays Pvt Ltd. (hereinafter referred to as “the Company,” “we,” “us,” or “our”). Please read them carefully before making a reservation.


1. Booking & Reservation

  • Reservation Confirmation: A booking is considered tentative until a non-refundable deposit or full payment (as specified at the time of booking) is received by the Company. Upon receipt, we will issue a written confirmation invoice, which finalizes the contract between the Client and Street Way Holidays Pvt Ltd.

  • Booking on Behalf of Others: The person making the booking (the “Lead Name”) is responsible for the entire booking, including payments and ensuring all other travelers are aware of and accept these Terms and Conditions. The Lead Name warrants they are at least 18 years of age and possess the authority to enter into this contract.

  • Right to Decline: We reserve the right to refuse any booking request at our sole discretion without providing a reason.

2. Pricing & Payments

  • Quotation Validity: All prices quoted are subject to change without notice until a booking is confirmed. Written confirmation (via email or official invoice) fixes the price, except for potential surcharges as outlined below.

  • Price Inclusions & Exclusions: Our tour price includes items as specified in the itinerary (e.g., accommodation, meals, transport, guided tours). It typically excludes international airfare, personal expenses (laundry, telephone, etc.), gratuities, travel insurance, visa fees, and any items not explicitly stated as included.

  • Taxes & Surcharges: Prices may be subject to change due to increases in government taxes, fuel surcharges, currency fluctuations, or other third-party cost increases that occur after the booking is made. The Client will be notified of any such surcharges before they are applied.

  • Payment Schedule: A specified non-refundable deposit per person is required to secure the booking. The balance must be paid in full no later than 30 days before the departure date. For bookings made within 30 days of departure, full payment is required immediately upon confirmation. Failure to pay the balance by the due date may be treated as a cancellation by the Client, and cancellation charges will apply.

3. Amendments & Extensions

  • Client-Requested Changes: Any request to amend a confirmed itinerary (e.g., changes to travel dates, accommodation, or activities) after the issuance of the confirmation invoice is subject to availability and will be actioned at the Company’s discretion. Such changes may incur administrative fees, cancellation charges from suppliers, and differences in tour cost.

  • Company-Requested Changes: The Company reserves the right to modify itineraries, accommodations, or transportation due to unforeseen circumstances, operational reasons, or events of Force Majeure. We will make every reasonable effort to provide alternatives of a similar standard. Significant changes will be communicated to the Client promptly.

  • Trip Extensions: Extensions or additional services requested during travel will be arranged subject to availability and charged separately at the prevailing rates.

4. Cancellation & Refunds

  • Cancellation by the Client: All cancellations must be received in writing by the Company from the Lead Name. The date of cancellation is the date on which the written notice is received at our office. Cancellation charges will apply as follows:

    • More than 30 days before departure: Loss of deposit.

    • 29 to 20 days before departure: 25% of the total tour cost.

    • 19 to 11 days before departure: 50% of the total tour cost.

    • 10 days or less before departure / No-Show: 100% of the total tour cost.

  • Refund Process: Refunds for cancellations made outside the penalty period (i.e., beyond the loss of deposit) will be processed using the original payment method within 7–10 working days from the date of written cancellation. All refunds are subject to the deduction of any applicable transaction fees.

  • Unused Services: No refunds or credits will be given for any unused portions of the itinerary, including but not limited to accommodation, transport, meals, or sightseeing, whether due to voluntary omission, early departure, or otherwise.

  • Force Majeure: No refunds will be issued for cancellations due to events of Force Majeure (as defined in Clause 7).

5. Responsibility & Liability

  • Agent Capacity: Street Way Holidays Pvt Ltd. acts as an intermediary agent in arranging transportation, accommodation, sightseeing, and other services. We are not responsible for the wrongful acts, omissions, breaches, negligence, or accidents of third-party providers such as hotels, airlines, cruise lines, tour guides, or transport operators.

  • Limitation of Liability: The Company shall not be liable for any loss, damage, injury, death, delay, or inconvenience to persons or property arising from any act of God, force majeure, mechanical breakdown, government actions, war, terrorism, civil unrest, or any other cause beyond our direct control.

  • Traveler Responsibility: It is the absolute duty of the traveler to:

    • Disclose any pre-existing medical conditions, disabilities, or special requirements that may affect their ability to fully participate in the tour.

    • Ensure they are medically and physically fit to undertake the chosen itinerary.

    • Hold valid travel insurance with comprehensive medical, evacuation, trip cancellation, and baggage loss coverage. Proof of insurance may be requested.

    • Behave in a manner that is not disruptive, dangerous, or offensive to other travelers or service providers. The Company may terminate the tour of any traveler for misconduct without refund.

6. Visa, Permits & Documentation

  • Travelers are solely responsible for obtaining a valid passport, necessary visas, permits, vaccination certificates, and other required travel documents for all countries included in their itinerary. The Company may provide general information, but it is the traveler’s responsibility to verify these requirements with the respective consulates. Failure to secure required documents will not entitle the traveler to a refund.

7. Force Majeure

  • The Company shall not be deemed in breach of this agreement or liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, epidemics, government restrictions or advisories, border closures, or any other event which makes it impossible or unsafe to perform the agreed services. Under such circumstances, the Company may, at its discretion, offer credit for a future tour or amend the itinerary, but no monetary refunds will be provided.

8. Website Use Disclaimer

  • The information, software, products, and services published on this website may include inaccuracies or typographical errors. The Company, its affiliates, and its suppliers make no representations about the suitability of the information for any purpose. All such information is provided “as is” without warranty of any kind. The Company shall not be liable for any direct, indirect, punitive, incidental, or consequential damages arising out of or in any way connected with the use of this website or with the delay or inability to use it.

9. Travel Insurance

  • Mandatory Requirement: It is a mandatory condition of booking with Street Way Holidays Pvt Ltd. that the Client obtains comprehensive travel insurance for the entire duration of their trip. This insurance must cover, at a minimum, personal accident and medical expenses, emergency evacuation and repatriation, cancellation and curtailment, and loss of personal effects. The Company shall not be liable for any costs incurred by the Client due to their failure to secure adequate insurance coverage.

10. Complaints & Dispute Resolution

  • In the unlikely event of a grievance during your trip, you must immediately inform both the local service provider and our representative (if available) to allow them the opportunity to rectify the situation. If the issue remains unresolved, a formal complaint must be submitted in writing to the Company within 30 days of the tour’s completion. We will acknowledge receipt and investigate the matter thoroughly.

11. Governing Law & Jurisdiction

  • This agreement and any disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the laws of India. Both parties irrevocably agree that the courts of Delhi, India, shall have exclusive jurisdiction to settle any such dispute or claim.
